Revised: 17th April 2017In these terms & conditions, The Company shall mean Perfectly Chilled LLP, herein after referred to as Perfectly Chilled Villas. The Client shall mean the person in whose name the booking is made and shall include the person & persons on whose behalf the same is made. Perfectly Chilled Villas act solely as the booking agent on behalf of owners/property agents for all villas in our portfolio.
The Client shall mean the person in whose name the booking is made and shall include the person or persons on whose behalf the same is made. Force Majeure shall mean any event outside the Company's control which prevents the prompt performance of its obligations, including war or threat of war, riot, civil strife, industrial disputes, terrorist activity, natural disaster, fire, epidemic, outbreaks of illness or adverse weather conditions.

Booking & DepositIn signing the booking conditions, the client accepts that Perfectly Chilled Villas are the booking agent and that there will be no recourse to Perfectly Chilled Villas in the event of a complaint or refund/ compensation claim. All properties are privately owned and therefore Perfectly Chilled Villas have no claim or authority over said properties. Perfectly Chilled Villas are under no obligation whatsoever to pay refunds, compensation or cover any costs, which the rental client may incur as a result of dissatisfaction with the rental property. (Please see Complaints section below.)
Prices are per property per week. Minimum duration one week, unless stated otherwise.
No contract is made between The Company and the client for the rental payment of the property and no booking is valid (and accordingly The Company shall have no obligations to the rental client) until The Company has received the reservation form and deposit /first payment or full payment for rental property has been taken. The Company will only then issue a confirmation of the booking. The Company has the right to refuse to accept any booking at The Company's discretion, refunding any deposit received. All documentation will be sent to the party leader who must be over 21 years of age & is deemed responsible for all matters relating to the holiday.
The maximum number of persons stated per villa or apartment must not be exceeded. If this is not observed Perfectly Chilled Villas or the owner have the right to terminate the booking.
The named property is reserved exclusively for the guests on the confirmation invoice. Other guests are only permitted if maximum numbers allow & additional payment is received (Where specified)
A 20 to 50% deposit (this may differ, please see property details pages) will be taken to confirm your booking. Full payment will be required if booking is taken less than 8 weeks prior to the commencement of your holiday. Payment can be made using Paypal (Visa/ Mastercard) or by bank transfer. Upon receipt of a deposit Perfectly Chilled Villas will forward a confirmation of the booking.
The Company reserves the right to treat the booking as cancelled if any part of the balance of the holiday price remains unpaid by the due date.
Perfectly Chilled Villas has the right to refuse to accept any booking, refunding any deposit received.
We reserve the right to increase or decrease our prices at any time prior to booking and you will be informed of the up to date price of your chosen holiday before you book. The price of your chosen property will be confirmed at the time of booking. In the unlikely event that there are any major changes made to the price of your booking (10% & above), you have the right to cancel your booking within 14 days of the final invoice date & receive a refund of all monies paid to us with the exception of any amendment charges. Change-over days are usually Saturdays (please see villa listing for confirmation of change-over day) in peak season but Perfectly Chilled Villas will accommodate your wishes where ever possible during high and low season.
Arrival & Departure TimesOn the day of arrival, keys to the property will not be generally available until after 4pm (Notification of arrival & departure times will be notified with your directions to the villa) unless previously agreed in writing by Perfectly Chilled Villas. This is due to preparation & cleaning of the property prior to your arrival. Arrivals should be between 4pm and 10pm. Clients who arrive late in the evening take full responsibility for finding the property or should notify Perfectly Chilled Villas of their late arrival time. Where possible clients should seek alternative accommodation for their late arrival and arrive at the villa during normal hours the following day.
At all Perfectly Chilled Villas properties a refundable security deposit is required. Please see villa listing page for security deposit details. Some villas require the security deposit to be paid with the balance payment. Others state 'To be held against credit card'.
Please see villa details page for confirmation of security deposit charge and how it is to be paid. You will be advised at the time of the booking. At some properties the security deposit is made directly to the owner or property manager. Clients are advised to read all the property details for confirmation.
For villas booked through Perfectly Chilled Villas, clients are advised that if the security/damage deposit is added to your final balance payment the refund will be subject to bank or credit card charges.
Upon instruction from the property owner, Perfectly Chilled Villas reserve the right to deduct any related charges, for wilful damage to rental house or it's private garden/pool, items that are broken or damaged & need to be replaced or repaired, if the property and garden is left in an unreasonable condition & extra cleaning or laundry service is deemed to be required. The decision of the owner is final. Clients are requested to replace all breakages prior to their departure. Gardens are private property and must not be tampered with. Fruit picking may be allowed, but guests are advised to consult with the property manager for confirmation. Non-compliance with this request will result in payments being deducted from monies held or from credit card. All damage to property and garden or its contents must be reported to the property manager immediately. Failure to do so will result in charges for repair or replacement being deducted from your security deposit. If the credit card security deposit box on the reservation form is not completed, the security deposit will be automatically added to your final balance payment. Clients are advised that we reserve the right to deduct any related charges incurred as a direct result of refunding the security deposit. We cannot be held responsible for any security deposit deductions that we carry out with the instructions of the owner/manager. If you have any complaints please notify Perfectly Chilled Villas and we will pass your comments onto the owner/manager.
NB: Please note that at some properties the security deposit charge may vary (please see details for each property). Guests may be requested to pay the charge locally upon arrival at the rental property. Clients are advised to read all the necessary information on the property details page. Deposits will be returned or credit card authorisations will be cancelled within 21 days after your return from holiday unless deductions have been advised, in which case the balance (if any) will be refunded.
Payment TermsThe full and final balance of the holiday rental price and any additional service charges are to be paid in full 8 weeks prior to the commencement of the holiday unless advised otherwise. Perfectly Chilled Villas is to be paid in pounds or euros regardless of currency fluctuations. If the booking is taken less than 2 weeks prior to the commencement of your holiday, payment can only be accepted by credit card. If final payment is not received by the date requested, Perfectly Chilled Villas reserve the right to cancel the booking, retain the deposit and apply cancellation charges as stated below.
If paying by bank transfer, balance & security deposit must be in Perfectly Chilled Villas bank account no later than 8 weeks prior to the commencement of your holiday. If not, Perfectly Chilled Villas may require payment to be made by credit card or the booking may not be accepted and booking deposit will be retained.
Perfectly Chilled Villas reserve the right to cancel your booking if the above payment conditions are not met. No invoices or receipts of payment will be issued unless specifically requested.
NB: Perfectly Chilled Villas offers a secure site for credit card bookings, however clients can provide credit card details by email at their own risk.
NB: Any special requirements must be advised at the time of booking and confirmed in writing on reservation form. We cannot be held responsible if clients do not advise of specific requirements.
Client AmendmentsAny alterations made to your booking may incur a charge of £50.00 per amendment. Wherever possible we will accommodate your wishes. In the unlikely event of Perfectly Chilled Villas having to make a major change to your booking, we will give the client the option of accepting the amendments, accepting an alternative property or a cancellation of the holiday with a full refund. Compensation will not be payable if we have to cancel the booking due to the actions of the property owner or change your holiday due to circumstances beyond our control or which come under the description of force majeure.
Cancellation ChargesCancellations must be sent in writing by the party leader to Perfectly Chilled Villas.
If notification is received in writing more than 2 calendar months prior to the commencement of the booked holiday, only the deposit will be retained by Perfectly Chilled Villas. Otherwise the following charges will apply: 8 to 4 weeks before: 50%, 4 weeks or less before: 100%. If there are genuine mitigating reasons for cancellation this will be taken into account, at the discretion of the owner. The owner's decision is final.
Liability of The CompanyThe Directors of Perfectly Chilled Villas cannot be held personally responsible for any death, injury, accidents, break ins or any other damage by whatever cause, unless it can be proved that it is due to the negligence of Perfectly Chilled Villas.
Perfectly Chilled Villas cannot be held personally responsible for any cuts to services such as water and power.
Perfectly Chilled Villas act only as booking agents and cannot be held personally responsible for the actions of the property owners. We are specifically not responsible for events outside our control or if there has been no fault by Perfectly Chilled Villas.
Perfectly Chilled Villas cannot be held responsible for any claims for refunds or compensation claims.
Perfectly Chilled Villas cannot be held responsible for client/owner payments in respect of credit card payment disputes. All refunds and compensation claims are at the discretion of the owner of the property.
Perfectly Chilled Villas do not accept liability for any disappointment experienced by the rental client due to unrealistic expectations regarding the rental property or it's location.
Perfectly Chilled Villas cannot be held personally responsible if you choose to abandon the rental property and make other arrangements. No refunds will be issued for abandonment of rental property. If there is a genuine reason for the property not being suitable, Perfectly Chilled Villas will find alternative accommodation, wherever possible.
Perfectly Chilled Villas cannot be held personally responsible for road conditions leading to the rental property. Please be aware that in ' real Spain ' only the main roads tend to be in good condition. Guests are advised to enquire about road conditions at the time of booking.
Parents are responsible for the safety of their children whilst staying at all properties managed by Perfectly Chilled Villas. Perfectly Chilled Villas cannot accept any liability due to parental negligence.
Perfectly Chilled Villas cannot be held responsible for any cuts in the supply of public services to the property.
Perfectly Chilled Villas cannot accept any liability for credit / debit card fraud when clients provide credit / debit card details by email.
InsuranceWe strongly recommend that you cover your villa vacation from unexpected surprises or events with Travel Insurance. That way you are covered in case of trip cancellation due to flight transportation difficulties, injuries or health problems. This may also apply for many unforeseen circumstances during your stay.
Perfectly Chilled Villas cannot be held personally responsible for any loss or damage experienced during the rental period.
Perfectly Chilled Villas advise that rental guests who intend to hire a car for the duration of their holiday should read the terms and conditions of their car rental company contract and be aware of clauses re: road surfaces and off road driving.
Photographs & Property DescriptionAll descriptions & location details of properties are given in good faith, but these are of course, only our opinions or the opinions of the villa owner. NB: Swimming pools will generally be available for use from May to October. Please enquire for all other dates during the low season to avoid disappointment. The photographs taken are intended to give an overall impression of the property & its environment. Please bear in mind that gardens may change over time. Perfectly Chilled Villas cannot be held responsible for any content changes or aspects of the environment, which could have changed since the photographs were taken. This includes the access roads leading to the rental properties and changes made to gardens or general growth of plants and hedges etc.
Perfectly Chilled Villas cannot be held responsible or accountable for any inaccuracy in the villa details page, all the information is provided in good faith by the property owner. We do recommend that all clients read details and terms of rental clearly and ask questions of Perfectly Chilled Villas should they require clarification of the facts.
Complaints and Refund/Compensation claimsGuests are advised that all refunds and compensation claims are at the discretion of the Villa owners. In signing these Booking Conditions, rental guests accept said conditions and that Perfectly Chilled Villas cannot be held responsible for refunds or claims for compensation. All complaints must be reported to the local managers verbally in the first instance. If the client is unhappy with the condition of the property it must be reported immediately, so that the owner/property manager can address the complaint, and arrange to deal with it immediately, where possible. Reporting a problem at the end of the rental, which could have been put right at the time may void any complaint presented. If the complaint cannot be resolved during your stay, it must be put in writing within 14 days of your return from your holiday. All complaints will be passed to the owners who will advise the local managers or Perfectly Chilled Villas as to an appropriate course of action. Local managers and Perfectly Chilled Villas are not responsible for refunds. The owner's decision is final.

NoisePerfectly Chilled Villas cannot be held responsible for any noise or disturbances arising outside the property boundary. We will of course inform clients of any disruptive noise or disturbance adjacent to your property, that has been made known to ourselves, which is likely to be happening at the time of your stay.
The Company shall not be liable for any noise, nuisance, disturbance or building work arising outside the accommodation supplied by the Company and caused by third parties beyond the control of the Company. A situation may develop, sometimes rapidly and intrusively, with little or no advance warning. The Company shall, however, make every to forewarn the Client if the Company has knowledge of this.
